LSK Warns Lawyers Working For State Against Stepping On The Law: "We'll Remove You From Roll Of Advocates"

The Law Society of Kenya (LSK) has called out the State organs over abuse of the law and asked them to shape up.

Law Society of Kenya warns lawyers working for DPP

Through its President Eric Theuri, the society took issue with the National Police Service, the Office of the Director of Public Prosecution (ODPP) and the Judiciary's upholding of the laws the country has been established on.

According to LSK, legal professionals attached to State organisations should uphold the law without being influenced by the powers.

Theuri warned its members working for State organisations that it would not hesitate to deregister them if they trampled on the law to please the State.

"We therefore wish to notify our members within the office of the Director of Public Prosecutions that, should they make decisions that betray the public trust, undermine the rule of law and bring disrepute to the legal profession.
"The Law Society of Kenya shall issue them with a certificate of dishonour and immediately commence proceedings to remove them from the roll of advocates," read a statement by Theuri.

Lawyers working for government

Theuri said that lawyers and Advocates of the High Court should be guided by the Constitution while dispensing their duties, and at no point should they trample on the supreme law of the country.

He observed that lawyers are responsible for serving the people and not the powers, even if they are working for government organisations.

"We have the responsibility to serve the people rather than the powers in accordance to to article 73 of the Constitution. Exercise utmost restraint when considering the action to take in respect of Kenyans exercising their bill of rights, including the right to assembly, demonstration, picketing and petition as guaranteed by article 37 of the Constitution," stated Theuri.

Nairobi senator Edwin Sifuna, an advocate of the High Court, said the message should be extended to lawyers serving in the executive and legislature.

Pauline Njoroge's arrest

"I’m also very proud of @lawsocietykenya for putting lawyers in @ODPP_KE who have forgotten their oath as advocates on notice. Kindly @etadv extend this to lawyers in the regime like Kindiki and those in Parliament who are presiding over the defilement of the Constitution they swore to uphold," Sifuna tweeted.

Sifuna was speaking about the incident in which vocal Jubilee official Pauline Njoroge and her peers were arrested over accusations of dealing in narcotics, only for the charges to be turned into cyber harassment.

The charges contradicted the police report that went public causing uproar on social media and across the political space.

During the arraignment, a taxi driver who was carrying Njoroge and her friend Nduta Kang'ethe bitterly wept and fainted in court.
