Nakuru - A Nakuru court has ordered Betika, owned by Shop and Deliver Ltd, to pay a gambler KSh 500,000.

Why Betika didn't want to pay

Nakuru Small Claims Court Resident Magistrate Edward Oboge's ruling followed a case David Juma filed after the betting firm refused to pay out his jackpot, Nation reported.

The magistrate faulted the betting company for refusing to pay Juma his winning despite him correctly predicting eight matches on February 17, 2023.

In his ruling, Oboge dismissed the argument by Betika that the gambler had only predicted seven matches correctly.

"The court agrees with the complainant that the respondent betrayed his trust by attempting to deny him the jackpot he won and I do not buy the argument that these facts were not known to the respondent," Oboge said.

Oboge said the evidence submitted by Juma to prove his claim, including witness statements and a bundle of documents, showed that he won eight bets, only one which was in dispute-the match between FC Juarez and Leon, which FC Juarez won.

According to the magistrate, investigations showed that the match between Publa and Cruz Azu was played on February 18, as shown by Juma and not on February 17, as was claimed by Betika.

"After a successful investigation of the facts, I have found that the match between Publa and Cru Azul was played on February 18, as correctly predicted and that FC Juare and Leon drew in the Mexican league; therefore, I reject the defendant's claim that all the matches on which bets were placed were played on February, 17," said the magistrate.

In his final orders, the magistrate also directed Betika to pay the costs of the case and interest from the date the jackpot was due to be paid.
