South Sudanese Family Gives Ringtone 7 Days To Return Missing Cars, Assets From Karen Home Or Sue Him

• The family of Matip accused Ringtone Apoko of forcibly taking over their Karen home and denying them access or use despite being the rightful owners
• Through their lawyers, the Matips claim that the land in question was registered in the name of their late father who bought it from Judith Guserwa in 2010
• They claimed that Ringtone illegally gained access to the land and locked them out from 2016, and that he had destroyed it and taken away two high end vehicles and other movables
• Matips have given Ringtone seven days dating back to Wednesday July 26, to return the missing cars and restore or pay for destructed material lest they sue him for recovery

Troubles surrounding Gospel singer Ringtone Apoko seem to be far from over even after he was arraigned with assault charges in a row involving a multimillion Karen home.

Ringtone Apoko property row escalates

The Pamela hit song singer is immersed in a battle for ownership of the multimillion property known as L.R No 65555 (Karen) with a Sudanese family comprising of Kongkong Paulino Matip, Gabriel Paulino Matip and John Paulino Matip.

According to the Matips, in a demand letter drawn by their lawyer Musyoki Kimanthi, they are the rightful owners of the land that is registered in the name of their father.

In a demand letter dated Wednesday, July 26, by Kimanthi Advocates, the three clients accuse Ringtone of illegally occupying, destructing and depriving them use of their property.

"Our clients are the legal and beneficial owners of the above-mentioned property which is currently registered under the name of their deceased father, having bought the same form one Judith Guserwa sometime in 2010," read the letter.

Sudanese family accuses Ringtone of property theft

According to the complainants, upon the death of their father they moved to South Sudan for his burial and remained there for a while due to exigencies of life.

They claim that they had left a caretaker to tend to the Karen home together with other movables and assets left at the property's compound.

The Matips indicated that they continued to send money for maintenance and upkeep of their property, oblivious that it had been taken over by a stranger whom they later established was Apoko.

"It was until sometime in 2016 when one of them, Kongkong Matip, visited Nairobi and went to the property only to be denied access. It is then that it was discovered that you, by means only known to yourself, had gained entry in to the property, and started passing off as the owner.

"You even went ahead to make structural changes to the property, adding unlicensed structures within the compound and leasing the same to strangers," the complainants stated through their lawyer.

High end cars in Karen home Ringtone is fighting for

They said, when they left for South Sudan, they left behind a fully furnished home alongside two vehicles; a Toyota VX and a BMW that were parked in the compound.

According to the demand letter addressed to Ringtone, the latter was successful in denying the complainants access to their property for seven years until they finally managed entry and repossession through the help of police officers on July 21, 2023.

"This was not before seven years of deprivation and denial of use, possession and benefit of their property had lapsed. Having gained access, our clients have established with utter shock the destruction that you have meted on that property.

"You have appropriated, misused, sold, stole or otherwise taken for yourself the assets that were within the house, including two cars above said.

Ringtone sued for assault

They accused Ringtone of hiring goons who meted violence and caused them actual bodily harm.

"There is no gainsaying that have since been charged in court. You would be foolish to imagine that this matter ended with your presentation in court for the assault above-said, and thus the reason we are now making this demand letter," the letter continued.

It was for this reason that the family instructed their lawyer to demand that Ringtone admits liability of forcibly detaining the property, illegally using and occupying it and destruction of the property coupled with profits.

Ringtone given seven days to return lost property in Karen home

"The purpose of this letter therefore is to demand your immediate admission of liability for forcible detainer, illegal use, occupation and destruction of our clients property, mesne profits and, but not limited to the value of the stolen property, eviction costs and other incidental costs.

"Please take notice that if we do not hear from you within seven days we shall move with speed and file recovery proceedings against you without any further reference to you," the letter concluded.

Ringtone on the other hand has cried foul, accusing the complainants of forcibly robbing him of his rightfully owned property.

The artiste, unlike a fool who quickly parts with his money, has closely courted controversy and was in court over an assault case pitting him against Kileleshwa MCA Robert Alai.
