The Jomo Kenyatta International Airport (JKIA) lease was put on hold pending a decision by the High Court.

The High Court granted prayers to the Kenya Human Rights Commission (KHRC) and the Law Society of Kenya (LSK) and issued an order blocking the implementation of Adani Airports PLC's proposal to take over the airport.

During a Senate Committee on Transport meeting on Monday, September 23, Treasury Cabinet Secretary John Mbadi confirmed that the deal has not yet been signed.

He explained that the Public Private Partnership (PPP) committee has paused its due diligence process until the ongoing court matter is resolved.

Mbadi also informed the Senate committee, led by Kiambu senator Karungo Thangwa, that if the court validates the deal, the Indian firm will still need to meet certain conditions before proceeding with the deal.

Conditions Treasury has demanded of Adani in JKIA deal

If the High Court allows the Adani deal to proceed, the company will have to meet the following conditions:

  1. Absorb all JKIA staff.
  2. Onboard all employees on better terms.
  3. Prioritise Kenyan nationals in all new recruitments.
  4. Engage with stakeholders through KAA.
  5. Conduct detailed due diligence on Adani Airport Holdings Limited.
  6. Review the risk matrix to identify and allocate all risks with suitable mitigation measures.
  7. Clearly define the development plan for refurbishing JKIA's existing terminal.
  8. Ensure the deal does not immediately increase current aeronautical and non-aeronautical charges.
  9. Follow due process for any increase in charges thereafter.
  10. Obtain Cabinet approval before signing the agreement.

Azimio coalition parties join case against Adani

Earlier, TUKO.co.ke reported that Azimio La Umoja One Kenya Coalition parties filed a lawsuit to challenge Indian firm Adani Group's acquisition of JKIA.

The Wiper Party, KANU, DAP Kenya, and the Jubilee Party joined in the matter of the illegal alienation of JKIA, a strategic national asset, against Adani Airports Holdings and others.

High Court announced a new date for the proceeding of the case, which blocks the implementation of the JKIA-Adani lease deal, has been pushed to October 17.
