Mutula Kilonzo's Law Firm Files KSh 69m Bill Against Moi's Estate For Defence Against SK Macharia

Mutula Kilonzo and Company Advocates has slapped Moi's estate with a KSh 69.7 million bill for defending the late retired president in a long-running against Royal Media Services (RMS) chairman SK Macharia.

The law firm, owned by the late Makueni senator Mutula Kilonzo, is now registered under his son Mutula Kilonzo Junior, the Makueni governor and his daughter Kethi Kilonzo.

Macharia had accused Moi and other government officials who served in his tenure of alleged violation of his rights and unjust enrichment.

The law firm sued Moi's estate through senior counsel Zehrabanu Janmohammed, whom Moi named the administrator of his will.

“Taking into consideration the value of the claim, the respondent’s interest in the suit and the time expended in defending the matter,” the bill of costs states, as reported by Business Daily.

Why SK Macharia sued Moi

According to Daily Nation, Macharia was forced to overpay a KSh 50 million loan he borrowed from Kenya Commercial Bank (KCB) and Kenya National Capital Corporation by over KSh 56 million.

He took a loan through his company, Madhupaper International, to manufacture tissues from recycled paper.

Even though the High Court ruled in his favour that he was forced to repay under duress, retired judges Justices Philip Tunoi, Erastus Githinji and Onyango Otieno overturned the decision.

Macharia also lost the case in the Supreme Court.

Why Moi's family lost prime lands

In related news, Moi and the late Kanu party strongman Nicholas Biwott were dealt a blow after a court in Eldoret ruled that five parcels of land they own belong to the public.

The court noted that the land sandwiched between Uganda Road, Oginga Odinga Street, Elgeyo Road and the road connecting Uganda Road at Zion Mall Junction was reserved for public utilities and was irregularly acquired.

Delivering the ruling, Justice Anthony Ombwayo said the plots on which a High Court, a district hospital, a fire station and an Administration Police camp were built belong to the public, and the title deeds being held by Lima Limited were null and void.
