Machakos - A High Court judge has ordered the detention of Gatundu South MP Gabriel Gathuka Kagombe over the Thika Town shooting incident.

On Monday, June 3, Kagombe was arraigned before Judge Francis Olel for the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code.

According to documents filed in court, Kagombe is accused of murdering David Nduati Wataha on May 17 in the Kimuchu area, Makongeni, in Thika.

Why GG Kagombe did not take plea

Justice Olel ordered the lawmaker to be detained at Muthaiga Police Station until Friday, June 7, when he will take his plea.

In his ruling, the judge said Kagombe should be taken to Kiambu Level 5 Hospital on Wednesday, June 5, for a mental assessment.

The judge further declined to release Kagombe, arguing that he should file an application once he is formally charged

“The accused should be released on anticipatory bond terms issued in Kiambu HRCC miscellaneous application no. 804 of 24, which was opposed by the state counsel on the basis of information that had been filed and anticipatory bail was no longer applicable as it would apply before formal charges were filed, and once filed, the same anticipatory bail has been overtaken by events, and the accused person will have to apply for a new bail/bond terms once formally charged before the High Court Machakos,” Justice Olel ruled.

What witnesses said about the Thika shooting incident

As reported earlier, witnesses claimed that the politician killed the youngster and injured others when he shot indiscriminately at members of the public.

Speaking to TUKO.co.ke’s My Story, Nduati’s elder brother, Alison Ndirangu recalled the dark day that changed their lives.

It all started when the brothers went to the Kamenu Market, where land was being allocated to small-scale business people.

As it happened, supporters of area MP Alice Ng’ang’a and those of Kamenu MCA Peter Mburu clashed, a disagreement that ended in chaos.
