Nairobi - The Kenya African National Union (KANU) suffered a significant setback, as Milimani Law Courts declared that the former ruling party had unlawfully obtained the land on which the Kenyatta International Convention Centre (KICC) stands.

Justice Jacqueline Mogeni of the Environment and Lands Court rendered a verdict on Monday, June 3, revoking the title granted to the party in 1989, ruling that the land rightfully belongs to the government.

"The allocation of the land to the petitioner was unlawful, illegal, and unconstitutional from the start," said the judge adding that the title deed offered to the Ministry of Tourism was valid, according to a report shared by Business Daily.

Justice Mogeni pointed out that the party failed to furnish evidence regarding the legitimate process for the allocation of public land to a political entity during the country's independence period.

KANU files petition about ownership of KICC

In 2020, KANU initiated legal proceedings aiming to reclaim both the land and the KICC building.

The party was ejected from the premises via an executive order in February 2003, during the tenure of President William Ruto and JB Muturi as the party's secretary general and organising secretary, respectively.

KANU appeals ruling about ownership of KICC land

Following the pivotal ruling, KANU remains steadfast in its stance, asserting that the acquisition of the land was conducted through proper procedures, and thus, they maintain rightful ownership.

Consequently, they have taken action by filing a notice of appeal to contest the ruling that questioned their ownership of the land.

"From the outset, KANU reaffirms its position that the allocation of the parcel of land was procedurally effected under the previous constitution. Therefore, we insist on our position that KANU is the legitimate and bona fide owner of the said parcel of land.
The party has already instructed its legal team to file a notice of appeal with immediate effect as the party combs through the substance of the judgment to issue a comprehensive statement in due course" read the statement witnessed by TUKO.co.ke.

High Court suspends sale of KICC

In November 2023, KICC was listed among 11 public entities slated for privatisation by the Kenyan government.

Nevertheless, the High Court halted the process, citing pending petitions that required attention.

Azimio leaders, such as Nairobi senator Edwin Sifuna, emphasised the iconic status of KICC as a venue cherished by Kenyans for its memories.
