Mombasa- Lamu Marine and Allied Product Limited director Mohamed Madhubuti is crying foul after being evicted from his property.

On Tuesday, June 11, Madhubuti was involved in an altercation with police officers as they forcefully evicted him from the building, which is valued at approximately KSh 200 million.

At the heart of this conflict is that the property located along Mwakilingo Road was used as security to acquire a loan from Standard Chartered Bank by the late Madhubuti's father's former business partners.

Who owns Lamu Marine house?

The bank would later seek to repossess the property in question, a move that was contested by Madhubuti.

However, after a long court battle, it was ruled that the documents used to present the house as a security for the loan were forged.

In official court documents seen by TUKO.co.ke, the Court of Appeal's Lady Justice Nyamweya, Justice Lesiit, and Justice Gatembu ruled in Madhubuti's favour in September 2023, ordering him to recover his property.

Speaking to this publication, Madhubuti said he has owned the building since 1983, and the official search for the suit property by the police from the Ministry of Lands proved he was the owner of the contested property.

The aggrieved Madhubuti questioned why Makupa Police Station OCS conducted his eviction, yet a search conducted by the police showed he was the bona fide owner of the property.

"I won the case in September 2023, the Court of Appeal ordered that the suit property be recovered by Lamu Marine. Suddenly, the police came and broke my locks and evicted me. I suspect the police are being used to frustrate me" said Madhubuti.

What is Madhubuti's request to Koome?

Madhubuti demanded that Inspector General of Police Japhet Koome intervene so he could recover his property.

He also demanded the director of investigations take his file from Makupa Police Station, claiming the station's officers might be compromised.

"I want the director of investigations to take my file from Makupa Police Station. I have no faith in that police station anymore. Imagine that the investigation officer who is investigating my complaint is the one who is coming together with his officers to evict me while armed.
"The one who knows the truth comes to evict me, and later on, he calls me saying, 'my brother I could not look you in the eyes, I was under instructions. I'm sorry. I know the truth," Madhubuti added.
